Reversal of Fortune

For several years, it seemed like there was no stopping entrepreneur Jeff Dudum and his family’s restaurant company from populating the country with sports- and nostalgia-themed restaurants. So, what happened and why did Bing Crosby's close suddenly?

 

Anyone who bought Bing Crosby’s gift cards as holiday presents didn’t see it coming. 

But the New Year’s Eve closure of Bing’s, a posh piano lounge homage to the late crooner, didn't surprise those familiar with the stacks of lawsuits, seeking millions in damages, filed against the restaurant’s owner, Dudum Sports and Entertainment, and against the company’s founders, brothers Jeff and Rick Dudum.

The Dudums say the economic downturn hit Bing Crosby’s in Broadway Plaza and other high-end venues in their restaurant empire hard. That, and competition from new upscale steakhouses such as Fleming’s and Ruth’s Chris —with a similar retro elegance and high prices — left the tables at the 280-seat Bing Crosby’s half filled some nights.

Meanwhile, the Dudums’ more casual, midpriced Walnut Creek restaurants, McCovey’s and the Carlos Santana-inspired Mexican restaurant Maria Maria La Cantina, are doing fine, the brothers say. Each restaurant is its own company. 

Nonetheless, the Dudum restaurant empire must navigate some dire financial straits.

The Dudums’ attorney Ray Rockwell, in a statement filed with court documents, spoke of the brothers fending off “various lawsuits” and dedicating “substantial amounts of time to dealing with lenders, suppliers, landlords and other creditors.” Rockwell’s statement was in a declaration filed in one of three lawsuits filed by banks that say the company and the brothers defaulted on loans. 

The coming year will bring court hearings and settlement conferences on at least a dozen lawsuits filed in Contra Costa, San Francisco, Sacramento and San Diego counties, as well as in federal court.

Two banks are suing the company and the Dudum brothers for $7.1 million in loan defaults. The other lawsuits contend that the brothers and DSE failed to pay about $2 million to distributors who sold food to their restaurants and to landlords and other companies for products and services. 

The debts amassed by DSE and related companies include at least $1.6 million in tax liens filed by Contra Costa and other counties, the states of California and Arizona and the federal government, according to court records and the Contra Costa Times.  These liens are associated with restaurant properties in Walnut Creek, Mill Valley, San Diego, Rancho Mirage and Arizona. 

In addition to Bing Crosby’s, McCovey’s and Maria, Maria, DSE owns Maria Maria La Cantina in Mill Valley, Tempe, Ariz. and Austin. Dudum Sports and Entertainment also owned Joe DiMaggio’s Chophouse, another top-market property, named for the famed New York Yankees slugger, in San Francisco. But that closed in October.

The Bing Crosby’s in Southern California also closed in recent months, the Times reported. Center Court, Jeff Dudum’s Sacramento restaurant venture with retired Sacramento Kings player Chris Webber, closed last year. Jeff Dudum and Dudum Sports and Entertainment were named as co-defendants in a lawsuit filed by the restaurant’s landlord claiming they owe $134,000 in rent, according to Sacramento County court records and the Sacramento Bankruptcy Lawyer blog. 

Jeff Dudum is no longer involved in DSE and had not been involved in Bing’s operations for about a year. His attention is focused on running the Maria Maria restaurants. 

In the glory days before the economic crash, he was the face of the company and its restaurants. He was seen as one of Walnut Creek’s movers and shakers who helped bring Walnut Creek’s dining and nightlife scene to a new level. 

“Without [Jeff] Dudum, the Creek might still be a sleepy town,” wrote Peter Crooks in a November 2004 profile of Dudum in Diablo magazine.

He was married to a successful local real estate agent, Mary Ellen Dudum, and the couple had two young sons. At the time of the Diablo profile, Bing Crosby’s was to be the sixth downtown business that Jeff Dudum opened in six years. He also owned the former Twist—described in Diablo as a “dose of big-city club life”—and Echo. He had owned the Cuban-themed Havana.

While the Dudum family likes to emphasize its philanthropic and community work, Jeff Dudum also is seen as one of Walnut Creek’s most controversial personalities. Several people who've had business dealings with him said he can be aggressive and arrogant. Dudum himself acknowledged his Type-A personality in his interview with Diablo. 

Rick Dudum, in an interview with the Times this week, tried to get across the point that the Dudum restaurant empire is not crumbling.

While Rick Dudum says that Maria Maria is “prospering,” IRS records show a $103,357 federal tax lien filed on Aug. 20 against the restaurant, the Times said. It also struggled after its owners “sank nearly $1 million into a new restaurant in Florida that was never completed,” the Times added. Court records show that DSE was sued by the landlord for $285,000 in back rent on the Mexican-themed restaurant’s property and others the company leased in Mill Valley and Santa Rosa.   

The Dudums acknowledged their liability in the case and a settlement was reached in which DSE would pay $16,952 each month, starting in July. A note would be guaranteed by Rick and Jeff Dudum and their father, Rocky Dudum.

The Times also reported that DSE sold McCovey’s to Rocky Dudum. This appears to be part of the reorganization the brothers are engaged in, according to their lawyer. The brothers, he said, “have been working diligently and dedicating significant time to reorganizing and managing the various businesses with which they are affiliated.” 

Records show the extent to which the brothers tried to expand their restaurant empire and then to keep it afloat once the recession hit.

Fremont Bank filed suit in April 2009, alleging that DSE, the Dudums and their business partner, Tom Gonzales, a Nevada-based investor, breached their promissory note on a $2,720,000 loan for construction on a new Maria Maria in Tempe, Ariz.  By March 2010, DSE had defaulted on the loan with $1,904,000 left on the balance. California Bank and Trust also filed suit in San Francisco County, seeking $5 million in damages. 

In February 2009, Jeff and Rick Dudum received an unsecured construction loan of about $200,000 from Comerica Bank. The brothers defaulted on that loan and then made a repayment agreement, but as of the February 2010 due date, Comerica had received only a third of what it was owed.

Comerica has asked the court to order each brother to account for all his real and other property, earnings, liabilities and outstanding loans. Fremont Bank is likely to do the same, according to Steven Mains, an attorney representing the bank.

The property includes both men’s homes, including Rick Dudum’s homes in Walnut Creek and Palm Desert and the house in Alamo that Jeff Dudum shared with his wife of 10 years and children. However, in another blow to Jeff Dudum, he and his wife separated last year. Mary Ellen Dudum filed for divorce Nov. 5, citing irreconcilable differences. This was three days after Bing Crosby’s hosted the election night party for new City Council member Kristina Lawson and McCovey’s hosted Mayor Cindy Silva’s bash.

Jay Hoyer, president of the Walnut Creek Chamber of Commerce, doesn't doubt that the economy played a major role in Bing Crosby's downfall. He credited the restaurant with bringing a certain "panache" to Walnut Creek's dining scene and expects that the building, reportedly owned by a Dudum family trust, will be occupied again soon because of its prime location in Broadway Plaza. 

The Dudums say they have been scrambling to find jobs for Bing’s employees. They also intend to honor Bing’s gift cards. Call 925-588-2941 to be reimbursed in some way.

I'd like to add that I think it's interesting how much play this restaurant's closing has had. Patch, Diablo's website, the CCT everywhere people are talking about it. You can not deny that the Dudum Empire changed the landscape of Walnut Creek's downtown scene for the better. It's unfortunate to see anyone go under or a business close and I wish them the best of luck in the future.

I find it strange that you wish these low lifes (DSE ownership) "the best of luck in the future." To structure shelters for all of their businesses from most financial liabilities then maximise loan debt(s), skip out on rent(s), stiff their suppliers, and hurt employees, why would you want to wish them luck? They've hurt a lot of people including the ones that you find "unfortunate". The initial cause of their demise was in fact a bad economy. However, this family knew exactly what they were doing. It wasn't poor business practices that closed these restaurants, it was the Dumdum Family's lack of scruples and the plan to take as much money, merchandise and livelihood out of any person or business that they could, no matter who gets hurt. It isn't bad business, it's CRIMINAL Fraud. DA's do your job!

What's interesting is jeff and mary ellen's divorce: they are still very much in love and care deeply about their kids. They still live together which leads most of their friends and associates to believe that this divorce is nothing more than to shelter mary ellen's and jeff's estate in the event of or for the coming filing of personal bankruptcy on jeff's part.

Jeff had also managed to rope in several wealthy individuals in the bay area through his association with kelly trevethan, a financial planner, with several business interests including maria maria.

Also, the employees at joe d's have been left in the lurch and several of them have had to file claims in small claims court against the dudums. Other employees in San Diego had had bounce checks and paychecks that did not show up on time.

There will probably be a host of suits to come and one has to wonder how well or how much time jeff can devote to running maria maria with all the lawsuits and whether he has access to the finances at maria maria given his personal financial issues.

There are stories replete with how ambitious (read greedy) the dudums are from tax medallion scam to bounce checks and leaving employees in the cold and no mention of honoring the gift cards for those who bought joe d's right before their sudden closure.

You are more right than you know. Apparently, he gets his financial investors through/introduced by a financial planner by the name of kelly trevethan of united capital/trevethan capital partners. I'm sure they will be interested to know what has been going on with their general partner, jeff dudum's legal and financial woes.

Also, the 925 number is always busy and you can't get in touch with any of these guys to get a refund:

Just as a follow up to my other replies. I did go down to their "Headquarters", (in a parking lot on Olympic) today along with many other people and exchanged my Gift Card for a couple of bottles of wine. At least they did something and they were very nice and apologetic, if that helps.

The number has been disconnected, website is no longer up and is available for use and even dudum's contact and info as part of maria maria has been removed. Yet, this guy is still going around town as if he owns it, laughing, smiling and glad handing unsuspecting suckers, I mean investors as recently as Easter weekend where I saw him in the Alamo/Diablo area.

The Dumdum's are getting all they deserve. With all the lawsuits...how is Maria Maria not affected and does Carlos Santa know how poorly the run these businesses? I'm sure they are running MM into the ground as well. People like the Dumdums don't just change. They should be locked up never to return to Walnut Creek! They are no better than the rats in New York!

Reply to Mary's question: Thank you Patch for the most helpful information on how to get in touch with Bing's on this situation. I called the phone number in your article, left a message, and got a phone call back about a week later saying to be at their corp. offices on Jan. 23 bet. 10 - 12 that day only, as they would be honoring their gift cards -- either with gift cards to another restaurant in Alamo (for half the value of your Bing's card) or for wine that they were clearing out. I heard someone there say, "this is it" -- and that was the only date/ time they would be doing this. They had quite a line of people there when we arrived just after 10 a.m. Our gift card was for over $200, so we feel at least we got something for it, and now can be done with the situation. All I can say is to keep trying the phone number?, or perhaps they can honor the card at one of their other restaurants? I understand their other restaurants are all "separately owned", but maybe even if you are still holding a Bing's card and you called directly to McCovey's (talk w/ a manager), and explained the situation with your Bing's gift card, they may be able to accommodate? I am sure yours would not be the first phone call like that they have gotten. Frankly, this whole situation has really made us think differently about gift cards -- we are not holding on to them - use them up quickly. Sadly, it has made us re-think dining at Walnut Creek establishments that are Dudum affiliated.

You and everyone else who is thinking of going to a dudum run establishment should think long and hard on the hundreds of people stiffed by them through their business practices and how they treat current and former employees and vendors. Their associates, like trevethan, is similarly untrustworthy with the common refrain that birds of feather flock together.

Thanks for your responses. I left a message at the phone number. Hopefully someone will call me back. The only reason I knew that they went out of business is because I called to make a reservation for Valentine's Day. I had no idea about the one day that they would honor gift cards. Hopefully they will do the right thing and reimburse me in some way, like they stated in this article. Thanks again.

Rick is married to Sandra. For now anyways, while Jeff is/was married to Mary-Ellen. They divorced last year but still live in the same house and sleep in the same bed raising their boys. The only reason they divorced, since they are still very much in love with each other, is that the divorce is a sham meant to protect their assets in the event Jeff files for chapter 11 bankruptcy. Rick is probably entertaining the same thing.

I haven't heard back from anyone. It's very disappointing. 5 families went in together to get us a $250 gift card and now we can't use it. It doesn't seem right. I wonder if there is anything else I can do??? I spoke to a manager at Maria Maria and she said that Jeff was coming in that night and she would ask him to call me. When I didn't hear from him I called her back and she said that Bing's is in bankruptcy and he does not plan on doing anything else for those with his gift cards. Very disheartening.......

Why would you be surprised or disappointed? That's how jeff and his partners (trevethan) operate. You may have to take him to small claims court or file a lien (maybe to small an amount.) But definitely spread the word and boycott his other restaurants/s (maria maria).

BTW, I saw him recently at the Warriors game this past tuesday the 15th, he was seated in the club levels about 7 rows back from the players, enjoying and laughing it up with his family and buddies.

Jane - you are absolutely correct. I don't think Carlos Santana realizes the whole story and trusted some of these individuals in his business dealings. In this triangle, it's kelly trevethan, the money man, that has kept feeding the dudum game with investors and investment dollars.
