Danville Angle on Potential Andersen Move

With Danville Mayor Candace Andersen's election win to Contra Costa County's District 2 seat, an early appointment is possible, leaving a hole on the Danville Town Council until November.

The Danville mayor received of the vote for District 2 supervisor, a seat now vacant due to the . With that vacancy, Gov. Jerry Brown may appoint Andersen early, leaving a hole on the Danville Town Council.

If Andersen is appointed to the supervisor's seat, the vacancy left by the exiting Andersen will remain unfilled until the Nov. 6 election.

"If Mayor Andersen is appointed to the Board of Supervisors, the seat would remain vacant until the November general election, at which time a replacement would be voted in and take office in December 2012," the town of Danville released in a statement Monday morning.

When a vacancy on Danville's town council occurs, council members usually have two methods to fill. It can either appoint someone to the seat or hold a special election.

Both methods for the potential Andersen vacancy, however, are off the table.

The council can't appointed a candidate because state law prohibits filling a vacancy by appointment if this action results in the majority of council being appointed, the town said in the statement. Currently on council, Karen Stepper and Robert Storer were both appointed at the end of their previous terms due to being unopposed in the 2010 election.

For the special election option, state law requires it to be scheduled at least 114 days after the election was called on June 5. The town said that since this time would put it near the general time frame November general election, there would be no need to set aside the special election date.
