Will You Get Married Now That Judge Says Same-Sex Marriages Should Resume in California?

Federal judge says California should cease its ban on same-sex marriages but extends his stay on counties issuing marriage licenses until next Wednesday.

Going to the courthouse? Gonna get married? 

The federal judge who last week struck down Proposition 8 as unconstitutional ruled today that same-sex marriages should resume immediately in Califiornia.

However, Chief U.S. District Judge Vaughn Walker put his decision on hold through Wednesday, meaning that marriage licenses cannot be issued right away to same-sex couples.

When Walker invalidated Proposition 8 last week, calling it discriminatory,  he also issued a temporary stay on allowing licenses to be issued to same-sex couples.  He lifted that stay briefly Thursday.

He said there is no  reason to bar same-sex couples from the right to wed, particularly in view of the fact that Gov. Arnold Schwarzenegger and Attorney General Jerry Brown--the state's top officials--agree that the marriages should be legal right away.

But Walker extended the stay to give proponents of Prop. 8 time to ask the Ninth U.S. Circuit Court of Appeals for another stay while a legal challenge to Walker's Prop. 8 ruling proceed. Walker's stay is in effect through 5 p.m. Wednesday.
